Terms & Conditions (the "Terms & Conditions") for Greeting Joy ("Greeting Joy" / "we" / "us" / "our" / the "Website").
Do not use the Website if you do not agree with the below Terms of Service (Terms & Conditions).
Use of the Website
A limited number of Credits may be available to try out the services provided by this Website.
For continued use, you are required to purchase additional Credits or subscribe to a plan.
Refunds can be issued ONLY for unused Credits if requested within 14 days of purchase. Refunds will not include any payment processing fees which are a minimum of 2.9% + $0.30 per transaction.
We do not guarantee that access to the Website will always be uninterrupted or be in the current form.
You must not upload any content to the Website that is protected by a copyright or intellectual property right which you do not have and attempt to hold us responsible for publishing such content.
You must not copy, use and distribute (or sell to your customers for the benefit of a competitor) any part of the Website for commercial purposes without obtaining a license from us first.
The use of any data mining or data extraction software on the Website is strictly forbidden.
We reserve the right to change, suspend or terminate the Website at anytime.
Your Account
Let us know as soon as possible if you suspect or know that someone has gained unauthorized access to your account.
You may sign in using email-based login codes or via third-party authentication providers such as Google or Apple. By using a social login provider, you authorise us to access limited profile information (name, email, profile picture) for the sole purpose of account creation and authentication.
We monitor all accounts for fraudulent behaviour (multiple accounts to attempt to manipulate the system in any way). We will immediately terminate all accounts that perform such actions to protect other members of the Website.
We reserve the right to suspend or terminate an account at our sole discretion.
We may also send you notifications such as card delivery updates, event reminders, and promotional offers. Preferences can be managed from the footer of any email you receive with such communication from us.
Services
Greeting Joy provides digital greeting card creation and delivery services including, but not limited to: personalised greeting cards with text messages, video messages, audio messages, AI-generated custom backgrounds, social/group cards with shared wishes, scheduled card delivery, and event reminders.
Card content (messages, media) is created by you and delivered to your specified recipients on your behalf.
Unless otherwise stated, it is fully your responsibility to review the content of your greeting cards before sending them. Once a card is delivered, it cannot be recalled.
Any abuse of our services will result in your account being reviewed and we will reach out to you to discuss. Failure to comply may result in your account being suspended or terminated, and no refunds will be given.
AI-Generated Content
Greeting Joy uses artificial intelligence (OpenAI) to generate custom card backgrounds based on your prompts. AI-generated images are provided "as is" and we make no guarantees about their suitability for any particular purpose.
You must not use the AI image generation feature to create content that is illegal, harmful, offensive, or that infringes on any third party's rights.
AI credits used for image generation are non-refundable once consumed, except in cases of technical failure where the generation did not produce a result (credits are automatically refunded in such cases).
Social / Group Cards
When you create a social or group card, you may share a link that allows others to add their wishes and messages. You are responsible for who you share this link with.
As the card creator, you have full control over the card's privacy settings, including whether to require approval for contributed wishes and whether contributors can see each other's messages.
Contributors who add wishes to a social card will have a basic account created with the email address they provide. This is necessary to associate their contribution with their identity.
Video and Audio Recordings
Video and audio recordings are captured directly in your browser and uploaded to our secure cloud storage. Recordings are limited to 60 seconds each.
You must not record or upload content that is illegal, harmful, or that infringes on any third party's rights.
We are not responsible for the content of user-recorded messages.
Scheduled Delivery
You may schedule greeting cards for future delivery. While we make every reasonable effort to deliver cards at the scheduled time, we cannot guarantee exact delivery times due to technical factors. Scheduled cards are processed periodically and may be delivered within a short window of the scheduled time.
Event Reminders
The event reminder feature sends you email notifications before upcoming occasions you have configured (birthdays, anniversaries, etc.). Reminders are sent as a courtesy and we cannot guarantee delivery of every reminder email. You remain responsible for remembering your own important dates.
Recipient Interactions
When a recipient views your card, you will be notified. Recipients may reply to your card, and their reply will be sent to you (and optionally to all contributors for social cards) via email.
We do not control the content of recipient replies and are not responsible for any messages exchanged through the reply feature.
Credits and Subscriptions
Card credits are required to send greeting cards. Credits can be purchased individually, in packs, or through an unlimited yearly subscription or lifetime deal (when available).
Unused credits do not expire as long as your account remains active.
Subscriptions can be managed through your billing portal. Cancellation of a subscription will take effect at the end of the current billing period.
AI credits are separate from card credits and are used for generating custom AI backgrounds. AI credits are included with certain purchases and can be purchased separately.
Prohibited Uses
You agree not to use Greeting Joy to:
- Send unsolicited, harassing, threatening, or abusive messages to recipients.
- Create content that is illegal, harmful, defamatory, obscene, or otherwise unlawful.
- Impersonate another person or misrepresent your identity.
- Upload content that infringes on any third party's intellectual property or privacy rights.
- Attempt to reverse-engineer, extract, or replicate any part of our technology.
- Use automated tools, bots, or scripts to access the service beyond its intended use.
- Circumvent usage limits, credits, or any technical restrictions.
Limitation of Liability
All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this Terms & Conditions.
Nothing in this Agreement limits or excludes the liability of Greeting Joy for:
- death or personal injury resulting from its negligence; or
- fraud or fraudulent misrepresentation.
We shall not under any circumstances be liable for:
- loss of profits; or
- any special, indirect or consequential loss, costs, damages, charges or expenses.
We will not be liable for any damage or loss in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with: your use of the Website or any aspect related to it.
Website Content
The Website's content and output from the services is for personal and informational purposes and comes with no warranties or guarantees of any kind.
External Web Resources and Links
Throughout the Website, you may find links to external web resources that are external to our Website. We do not control or manage the content in the external web resources and cannot guarantee the correctness of information contained in such resources.
We may not be held liable in any way if the actions you took based on the content in external web resources to the Website resulted in an unfortunate event.
You may link to our website, but when doing so, please do it in a legal and fair way to not damage our reputation.
Viruses
We take reasonable steps to ensure the Website is free of viruses, however we cannot guarantee it will be free of viruses or other unwanted software at all times.
It is your responsibility to ensure that the device you use to access the Website has updated anti-virus software active on it.
You must not upload or attempt to transfer viruses or other unwanted software via the Website.
